Terms of Service

This service is operated by Prevyu / PrevYou. By using our services, you agree to these terms.

Pre-Release Phase: These services are currently in limited pre-release testing. We reserve the right to suspend access or modify features without notice.

Modifications: We reserve the right to modify these Terms at any time. Your continued use of the service after modifications constitutes acceptance of the new terms.

By accessing and using the services of Prevyu / PrevYou ("we", "our", "us"), including our website, mobile applications, and artificial intelligence services (collectively, the "Services"), you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms, you must not use our Services.

2. Service Description

Prevyu / PrevYou provides:

  • AI-powered personalized fashion recommendations
  • Virtual try-on via AI image processing
  • Product discovery with affiliate links to merchant partners
  • Inspiring content and curated daily looks

3. User Account and Eligibility

  • You must be at least 18 years old or have reached the legal age of majority in your country to use our Services.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate, current, and complete information during registration.
  • You are responsible for all activities that occur on your account.

4. User Content and Photos

By uploading photos to our Services, you confirm that:

  • You own the rights to these photos or have obtained the necessary consent to use them
  • You are at least 18 years old (or the legal age of majority in your country)
  • If you upload photos of other people, you have obtained their explicit written consent
  • The photos do not contain inappropriate, illegal, or offensive content

License granted to us: By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, display, and store your photos solely for the purpose of providing our Services.

5. AI-Generated Content and Ownership

Our Services use artificial intelligence to generate virtual try-on images and recommendations. These AI-generated images are approximations and should not be considered exact representations of how products will look.

You own the AI-generated images you create via our Services.

You are responsible for using AI-generated images in accordance with applicable laws.

6. Prohibited Uses

You agree not to:

  • Upload or generate content involving minors (persons under 18 years old)
  • Create content that impersonates real individuals without explicit consent
  • Use the Services for illegal, fraudulent, or deceptive purposes
  • Create violent, hateful, discriminatory, or offensive content
  • Interfere with the proper functioning of the Services
  • Use robots, scrapers, or automated methods to extract data
  • Decompile, reverse engineer, or attempt to discover the source code of our AI systems

7. Affiliate Program and Purchases

  • Prevyu / PrevYou participates in affiliate programs with merchant partners.
  • We may receive commissions on purchases made through affiliate links on our Services.
  • You have no obligation to purchase through our links.
  • We are not responsible for the quality, delivery, or customer service of products sold by third parties.

8. Payments and Subscriptions

If you subscribe to premium features:

  • Fees: Subscription fees are charged in advance on a monthly or annual basis.
  • Automatic Renewal: Your subscription will automatically renew unless you cancel before the renewal date.
  • No Refunds: Due to high GPU processing costs, we cannot offer refunds for services already provided.
  • Cancellation: You can cancel your subscription at any time via your account settings.

9. Termination

  • By us: We may suspend or terminate your access to the Services at any time if you violate these Terms.
  • By you: You can delete your account at any time via your account settings.
  • Effect: Upon termination, your right to use the Services will cease immediately and your data will be deleted in accordance with our Privacy Policy.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT GUARANTEE THE ACCURACY OF AI-GENERATED IMAGES OR PRODUCT RECOMMENDATIONS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PREVYU / PREVYOU SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS (OR €100 IF HIGHER).

12. Indemnification

You agree to defend, indemnify, and hold harmless Prevyu / PrevYou against any claim, damage, obligation, loss, liability, cost, or debt arising from your use of the Services or your violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by posting the new Terms with an updated "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

14. Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of French courts.
